  • Account Security: You are responsible for safeguarding your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

3. Acceptable Use Policy

You agree not to:

  • Reverse engineer, decompile, or extract source code or underlying architecture from the Service.
  • Use automated scrapers, bots, or unauthorized API scripts to query or extract platform data.
  • Attempt to breach or probe platform security measures, authentication systems, or cloud infrastructure.
  • Use the Service for any unlawful, harassing, or unauthorized purpose.

4. Intellectual Property & Data Ownership

  • IronMind IP: The platform, proprietary algorithms, trade secrets, trademarks, software, and user interfaces are the exclusive property of IronMind, Inc.
  • Your Data: You retain full ownership of all raw physiological data, wearable signals, and content you submit. You grant IronMind a worldwide, non-exclusive, royalty-free license to process and transmit your data solely to deliver the Service.

5. Third-Party Integrations

The Service may connect with third-party wearable hardware and platforms (e.g., Apple, Oura, Whoop, Garmin). IronMind is not responsible for the availability, privacy practices, or hardware accuracy of third-party platforms.

6. Disclaimer of Warranties & Limitation of Liability

  • "AS IS" Basis: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
  • Liability Cap: To the maximum extent permitted by law, IronMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our aggregate liability for all claims shall not exceed the amount paid by you to IronMind in the twelve (12) months preceding the incident.

7. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, without prior notice, if you violate these Terms or engage in activities that jeopardize system integrity.

8. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal disputes shall be resolved through binding arbitration or state/federal courts located in Delaware.
